Terms of Service

1. General Provisions

This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between the administration of the MarkApp service (hereinafter referred to as the "Administration") and the user of the service (hereinafter referred to as the "User").

By registering in the Service, the User confirms that they have read this Agreement and accept all its terms.

2. Subject of the Agreement

The Administration provides the User with software (iOS application and web service) for automating the processes of internet advertising labeling in accordance with the requirements of the legislation of the Russian Federation.

3. Registration and Account

3.1. Registration Requirements

• Registration is required to use the Service
• Accurate information must be provided during registration
• The User undertakes not to transfer their credentials to third parties
• The User is responsible for all actions performed under their account

3.2. Authorization through Telegram

The Service uses authorization through Telegram. By registering in the Service, you agree to the transfer of your Telegram account data (ID, username) for identification.

4. Rights and Obligations of the Parties

4.1. The Administration undertakes to:

• Provide access to Service features
• Ensure the confidentiality of personal data
• Provide technical support
• Notify about scheduled work and changes in the Service

4.2. The Administration has the right to:

• Modify the Agreement terms unilaterally
• Suspend the Service for technical work
• Restrict or terminate access to the Service in case of violation of terms
• Delete content that violates legislation or Agreement terms

4.3. The User undertakes to:

• Comply with the legislation of the Russian Federation when using the Service
• Not use the Service for illegal purposes
• Not violate the rights of third parties
• Provide accurate information
• Pay for services in a timely manner according to the selected tariff

4.4. The User has the right to:

• Use all Service features according to the selected tariff
• Receive technical support
• Delete their account at any time
• Export their data from the Service

5. Tariffs and Payment

5.1. Tariff Plans

The Service is provided on a paid basis according to tariff plans published on the website.

5.2. Payment

• Payment is made by prepayment
• Access to features is provided after payment confirmation
• Service prices are indicated in Russian rubles

5.3. Refund

Refunds are possible within 14 days from the date of payment, provided that the User has not used the paid features of the Service.

6. Intellectual Property

All exclusive rights to the Service, including software, design, texts, graphics, and other elements, belong to the Administration.

The User receives a non-exclusive license to use the Service in accordance with the terms of this Agreement.

7. Liability and Limitations

7.1. Limitation of Liability

• The Service is provided "as is" without any warranties
• The Administration is not responsible for interruptions in the Service
• The Administration is not responsible for actions of third parties
• The User is responsible for the accuracy of data entered into the Service

7.2. Content Liability

The User is fully responsible for content posted using the Service, including creatives, advertisement texts, and other materials.

8. Confidentiality

Processing of personal data is carried out in accordance with the Privacy Policy.

9. Termination of Use

The User may terminate use of the Service at any time by deleting their account.

The Administration may terminate access to the Service in case of violation of Agreement terms or the legislation of the Russian Federation.

10. Changes to the Agreement

The Administration reserves the right to modify the terms of this Agreement unilaterally.

A new version of the Agreement comes into effect from the moment it is posted on the website, unless otherwise provided by the new version.

11. Dispute Resolution

All disputes under this Agreement are resolved through negotiations. If no agreement is reached, the dispute is subject to consideration in court at the location of the Administration.
